1. Accessibility Commitment (ADA & WCAG 2.2)

The Foundation is committed to digital inclusion and targets WCAG 2.2 Level AA conformance. By using this site, you acknowledge that web accessibility is a dynamic process. Should you encounter a barrier, you agree to provide the Foundation with a 45-day "Notice and Cure" period to resolve the accessibility issue before initiating any formal legal or administrative claim. We explicitly disclaim liability for third-party widgets (e.g., GoFundMe) that may not fully meet these standards.

2. Medical & Diagnostic Disclaimer

The Foundation is an advocacy organization, not a healthcare provider. WE DO NOT PROVIDE MEDICAL ADVICE. Any information, including data from our Symptom Tracker, is for personal reference only. Treatment decisions and clinical pathways must be made in direct consultation with a licensed medical professional. The Foundation does not urge or endorse specific medical pathways; adhering to your doctor's feedback is mandatory for your health safety.

3. FTC Health Breach Notification Compliance

As a vendor of personal health records (PHR) via "Chiari Connects," we comply with the FTC Health Breach Notification Rule (16 CFR Part 318). In the event of unauthorized acquisition of your unsecured identifiable health information, we will notify you and the FTC within 60 calendar days (or sooner if mandated by state law).

4. Protection of Minors (KOSA/COPPA)

We do not knowingly collect data from children under 13 without verifiable parental consent. Pursuant to 2026 Online Safety Acts, any user under 18 (or their legal guardian) may exercise the "Eraser Button" right to have all identifiable personal and medical data permanently purged from our servers (Supabase/Firebase).

5. AI Transparency & Automated Decision-Making

The Foundation utilizes Automated Decision-Making Technology (ADMT) and AI to assist in symptom analysis. These tools provide probabilistic insights and are never a substitute for a human physician. You have the right to request information about the logic behind any AI-driven recommendation provided by our platform.

6. IRS Compliance & Private Inurement

Organized exclusively for charitable purposes under Section 501(c)(3), no part of the Foundation’s net earnings shall inure to the benefit of any private individual. The Foundation does not participate in political campaigns or prohibited lobbying. Violation of this non-partisan policy by users in Foundation forums will result in immediate expulsion.

7. Anti-Kickback & Stark Law Compliance

The Foundation strictly adheres to the Federal Anti-Kickback Statute. We do not receive compensation for specialist referrals. Users are prohibited from using this platform to facilitate "patient brokering" or insurance fraud; all suspected violations will be reported to the relevant authorities.

8. Provider Directory & Non-Endorsement Policy

Our directory of specialists and support groups is for informational convenience only. LISTING DOES NOT CONSTITUTE ENDORSEMENT. We do not verify medical licenses or clinical competency. You agree that any relationship formed with a provider is solely between you and that third party; the Foundation is not liable for medical malpractice or negligence by entities listed.

9. Immunity Under the Volunteer Protection Act

Pursuant to the Federal Volunteer Protection Act of 1997 and Florida Statute §768.1355, the directors and officers (including Derek Lucius Crosby and Eric Crosby) are shielded from liability for acts or omissions resulting in harm if they were acting within the scope of Foundation responsibilities and the harm was not caused by willful or criminal misconduct.

10. Warrior Stories & HIPAA Waiver

By submitting content, you grant the Foundation an irrevocable, perpetual, worldwide license to use such content. You acknowledge this is a voluntary public disclosure of sensitive health data and explicitly waive all PHI/HIPAA confidentiality claims regarding this specific content.

11. Foreign Source Compliance (Florida SB 700)

Per Florida SB 700, the Foundation certifies it does not accept funding from Foreign Countries of Concern. By donating, you represent that you are not a prohibited foreign agent or entity under Florida law.

12. Liquidated Damages & Jury Trial Waiver

TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF THE FOUNDATION FOR ANY CLAIM SHALL NOT EXCEED $100.00 USD. ALL DISPUTES SHALL BE ADJUDICATED EXCLUSIVELY IN ST. JOHNS COUNTY, FLORIDA. BY USING THIS SITE, YOU VOLUNTARILY WAIVE YOUR RIGHT TO A JURY TRIAL.
